Where abuse of power can hide

These are weak spots to understand, not loopholes to exploit. Each one needs facts, source documents, and careful wording.

Before signing

  • Who contacted the solicitor or will writer?
  • Who gave instructions?
  • Was the will-maker seen alone?
  • Were old wills and family claims discussed?

At signing

  • Was the will-maker lucid and free to choose?
  • Was the will read and understood?
  • Were witnesses independent?
  • Was the same document signed properly?

After death

  • Who holds the original will?
  • Has probate or confirmation started?
  • Are assets moving?
  • Is the executor giving basic updates?

System weak spots

  1. Pressure happens in private. The will-maker cannot explain after death.
  2. Suspicion is not proof. A checklist can show risk, but a court needs evidence.
  3. The arranger may control evidence. The same person may book appointments, transport the will-maker, hold papers, and become executor.
  4. Capacity can fluctuate. Timing of instructions and signing can be decisive.
  5. Executor misconduct is a separate path. Bad administration may not prove the will was invalid.
